Welcome to Diecast Collectors Club (“the Site,” “we,” “us,” or “our”). By accessing or using our website at diecastcollectors.club, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Site.

1. Acceptance of Terms

By creating an account, accessing, or using Diecast Collectors Club, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms apply to all users of the Site.

2. Description of Service

Diecast Collectors Club is a community platform where diecast collectors can:

  • Share “hunts” (diecasts they are searching for)
  • Post “deals” they discover in stores or online
  • Connect with fellow collectors
  • Help others complete their collections
  • Comment on profiles, hunts, and deals

Important: This Site is purely for information sharing. It is NOT a marketplace for buying, selling, or trading diecasts. Any sales, trades, or transactions between users must occur outside of our platform (such as through Reddit direct messages) and are entirely at the users’ own risk.

3. Account Registration and Reddit Integration

3.1 Reddit Authentication

The Site uses Reddit for authentication. You must have a valid Reddit account to use our services. By using our Site, you agree to comply with these Terms of Service. You are responsible for maintaining compliance with Reddit’s own Terms of Service when using Reddit’s platform.

3.2 Account Responsibility

  • You are responsible for maintaining the security of your Reddit account
  • We are not responsible for any issues related to Reddit login, authentication failures, or Reddit service disruptions
  • A ban from Reddit does not automatically result in a ban from Diecast Collectors Club, and vice versa
  • You are responsible for all activity that occurs under your account

3.3 Account Termination

You may request account deletion by contacting us at gdpr@diecastcollectors.club. Upon deletion, your username will be removed, but your posts and comments will remain visible on the Site as they contribute to the community knowledge base.

4. User Conduct

4.1 General Principles

Be nice, share information, and don’t be a jerk. We’re all here to help each other build amazing collections.

4.2 Prohibited Conduct

You may not:

  • Post spam or advertise unrelated products or services
  • Harass, threaten, or abuse other users
  • Intentionally post fake hunts or deals
  • Share personal information of others without consent (doxxing)
  • Post illegal content or encourage illegal activities
  • Impersonate other users, collectors, or entities
  • Engage in scalping activities or promote price gouging
  • Use the Site to buy, sell, or trade diecasts (use Reddit DMs or other platforms for transactions)
  • Attempt to manipulate ratings, flags, or community features
  • Violate any applicable local, national, or international law

4.3 Scalping Policy

This Site was created to help collectors avoid scalpers. Any user found to be promoting scalping, price gouging, or bulk-buying for resale purposes will be permanently banned.

5. User Content

5.1 Content Ownership and License

When you post hunts, deals, comments, or any other content on the Site, you retain any ownership rights you have in that content. However, by posting content, you grant Diecast Collectors Club and its users a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content on the Site.

Given the informational and community-focused nature of the Site, all content you post is considered shared and public information intended to help fellow collectors.

5.2 Content Responsibility

  • You are solely responsible for the content you post
  • You represent that you have all necessary rights to post your content
  • We are not responsible for the accuracy, completeness, or reliability of any user-generated content
  • We do not endorse any content posted by users

5.3 Content Moderation

We reserve the right to remove, edit, or refuse to post any content that:

  • Violates these Terms
  • We believe may be harmful to users, the Site, or third parties
  • Has been flagged by the community
  • Is spam, fake, or misleading

Users can flag inappropriate content and rate other users. All flags and ratings are reviewed by site administrators.

5.4 Banned User Content

When a user is banned, their content will remain on the Site at our discretion, as it may contain valuable information for the community. However, we reserve the right to remove all content from users who engaged in harassment, abusive behavior, or posted inappropriate material.

6. Deals and Hunts Disclaimer

6.1 No Guarantee of Accuracy

  • Prices, availability, and store information can change at any time
  • We do not guarantee the accuracy of any deals or hunts posted on the Site
  • Users post information based on their own experiences and observations
  • Always verify information before making purchasing decisions

6.2 No Liability for Transactions

  • We are not responsible if a posted deal turns out to be inaccurate, expired, or fraudulent
  • We are not a party to any transactions between users and retailers
  • We are not liable for any losses, damages, or disputes arising from deals found on the Site

6.3 Meetups and In-Person Interactions

If users choose to meet in person based on connections made through the Site, they do so entirely at their own risk. We are not liable for any outcomes, positive or negative, resulting from in-person meetings or any interactions that occur outside the Site.

7. Intellectual Property

7.1 Site Content

The Site design, logo, name “Diecast Collectors Club,” and all original content are owned by us or our licensors. Users may not:

  • Copy, reproduce, or steal our site design or branding
  • Use our name, logo, or branding without permission
  • Create derivative works based on our Site

7.2 Third-Party Trademarks

Diecast brand names, logos, and images (such as Hot Wheels, Matchbox, and others) are trademarks of their respective owners. We do not claim ownership of these trademarks. Their use on our Site is for informational and community purposes only.

8. Moderation and Enforcement

8.1 Administrator Discretion

As the Site administrator, I have full discretion to:

  • Warn users who violate these Terms
  • Temporarily or permanently ban users based on the severity of violations
  • Remove or edit content at any time
  • Make case-by-case decisions regarding disputes between users

8.2 Ban Duration

Depending on the severity of the violation, bans may be:

  • Temporary (days, weeks, or months)
  • Permanent

Serious violations such as harassment, doxxing, scalping promotion, or illegal activity will typically result in immediate permanent bans.

8.3 Appeals

If you believe you were banned or had content removed in error, you may appeal by contacting appeal@diecastcollectors.club. We will review your appeal, but our decision is final.

9. Disclaimers and Limitation of Liability

9.1 “As Is” Service

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Warranty

We do not warrant that:

  • The Site will be uninterrupted, secure, or error-free
  • Any content on the Site is accurate or reliable
  • Any defects will be corrected
  • The Site will meet your expectations

9.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DIECAST COLLECTORS CLUB AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your use or inability to use the Site
  • Any content posted by users
  • Any dealings or interactions with other users
  • Any unauthorized access to or use of our servers

10. Modifications to Terms

We reserve the right to modify these Terms at any time. When we make changes, we will post the updated Terms on the Site with a new “Last Updated” date.

By continuing to use the Site after changes are posted, you automatically agree to the updated Terms. We encourage you to review these Terms periodically. If you do not agree with any changes, you must stop using the Site.

11. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Site (or any part thereof) at any time, with or without notice, for any reason. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Site.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where you, the user, reside, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Site shall be resolved in the courts of your jurisdiction.

13. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Diecast Collectors Club regarding your use of the Site.
